VIVA Studio Berlin – Viva Konzept GmbH

1. Scope and Contracting Party
These Terms and Conditions apply to all services, bookings, and offers provided by Viva Konzept GmbH, operating under the name VIVA Studio Berlin, located at Wilmersdorfer Str. 98/99, 10629 Berlin, Germany (hereinafter referred to as “VIVA Studio Berlin” or “we”).
By booking a service via our website, Eversports, by email, or in person, you agree to be bound by these Terms and Conditions.
2. Services & Contract Types
We offer the following services:
Single classes (Drop-In)
10 and 20 Class Passes
VIVA Club Passes, Student Passes, Over 65 Passes
Explorer Passes (3 classes or flatrate)
6-Month and Annual Memberships
Private sessions
Workshops and special events
Gift vouchers (via Eversports)

3. Booking & Payment
3.1 Booking:
Bookings can be made online via Eversports or directly at the studio. A confirmed booking is required to participate in any class.
3.2 Payment Methods:
We accept the following payment methods:
Credit card (via Eversports and on-site)
Debit card (on-site)
PayPal (online and via Eversports)
Cash (on-site)
4. Right of Withdrawal & Cancellations
4.1 Right of Withdrawal:
As a consumer, you have the right to withdraw from your purchase within 14 days of the date of contract without providing any reason (“Widerrufsrecht”).
Any services already used (e.g., attended classes) will be deducted from the total refund.
4.2 Class Cancellations:
Drop-in classes and class passes can be cancelled free of charge up to 24 hours before the start of the class.
Late cancellations or no-shows are non-refundable and cannot be rescheduled.
4.3 Workshops & Special Events:
Separate cancellation policies apply to workshops and special events and will be clearly communicated at the time of booking.
5. Memberships
5.1 Duration & Cancellation:
Memberships are available as 6-month or annual contracts.
Cancellations must be submitted at least 30 days before the end of the contract term.
If no timely cancellation is made, the contract will automatically renew for the same duration.
5.2 Pausing Memberships:
Memberships may be paused upon individual request (e.g. illness, extended travel). There is no automatic right to a pause.
5.3 Transferability:
Memberships are personal and non-transferable.
6. Studio Rules & Code of Conduct
Socks or flip-flops must be worn outside of the changing rooms. For hygiene reasons, barefoot walking around the studio is not allowed.
Yoga mats and props are provided and disinfected after each class. Please do not bring your own mats or props.
If you are feeling unwell or have flu-like symptoms, please stay at home.
Mobile phones are not allowed inside the yoga rooms and must be stored in the lockers or changing rooms.
No food is allowed in the yoga rooms.
We expect respectful behavior towards staff, other guests, and the studio environment at all times.
7. Café Rules
Outside food and beverages (including non-alcoholic drinks) are not allowed in the café.
Please be aware that the café is a multifunctional space where yoga classes and massages may take place. Be mindful of volume and behavior.
The café is self-service. Please return your dishes and cutlery to the counter after use.
Respectful treatment of our staff and the space is expected.
8. Liability Disclaimer
Participation in all activities is at your own risk.
We are not liable for injuries, health issues, accidents, or damages incurred during classes, workshops, or other events.
We are also not liable for lost or stolen items. Please do not leave valuables unattended.
9. Gift Vouchers
Gift vouchers can be purchased online via Eversports or directly in the studio and can be redeemed for any service offered by VIVA Studio Berlin.
Vouchers are valid for three years from the date of purchase and are not redeemable for cash.
10. Changes to Offerings
We reserve the right to change class schedules, pricing, services, or instructors at any time.
There is no guarantee for specific classes, teachers, or times.
11. House Rules & Exclusion
VIVA Studio Berlin reserves the right to exercise house rules.
Individuals who disturb operations or violate hygiene or behavioral policies may be temporarily or permanently excluded from participation.
In such cases, no refund will be granted.
12. Governing Law & Jurisdiction
These Terms are governed exclusively by the laws of the Federal Republic of Germany.
The place of jurisdiction for any disputes arising from these Terms is Berlin, where legally permissible.
13. Severability Clause
If any provision of these Terms is or becomes invalid, the remaining provisions shall remain unaffected.
In such cases, the invalid provision shall be replaced by a valid one that most closely reflects the original intent.
